JOLIET — Six months ago, Joliet criminal defense attorney for Bob Hernandez convinced Will County’s judiciary to release his wheelchair bound client from the Will County jail because of a variety of ailments and serious medical concerns. The judge agreed, but he placed Hernandez under severe restrictions, essentially putting the Joliet crack cocaine and stalking defendant under house arrest.

Hernandez, who turns 63 this weekend, resides in the 800 block of Westminster Road with his parents.

According to the recent motion to modify the conditions of Hernandez’s pretrial release, “the defendant respectfully requests this honorable court … to allow him to leave his residence to walk to Black Road, to Ruby Street, to Chicago Street; and Black Road to Larkin Avenue to Plainfield Road, to Ruby Street, to Broadway and back home outside for exercise.”

Tomczak’s filing also asks Will County Judge John Connor to modify the conditions of Hernandez’s pretrial release “to allow him to walk around his home to Black Road to Larkin Avenue to Jefferson Street to therapy and Walmart for his prescriptions.”

A court hearing on the motion will be heard on Friday morning in front of Judge Connor. Will County Jail records indicate that Hernandez was kept in the jail from the time of his second arrest by the Joliet police force in a matter of weeks, on Feb. 14 until March 14, when Tomczak prevailed on behalf of his client at the courthouse.

In February, Patch reported that Joliet police visited Hernandez at his place of employment and served him with a stalking no-contact order. Hernandez is prohibited from having any contact with a 36-year-old Joliet woman and her teenage children, ages 17 and 19.

Will County Judge Tom Slazyk granted the emergency order of protection against Hernandez. In late January, Hernandez’s car was impounded by Joliet’s Police Department and officers had a search warrant to seize the two cell phones belonging to Hernandez, according to Joliet police officials. Police also seized $220 cash at his Jan. 26 arrest, according to court documents.
